While these sketches are described in broad strokes, my intention in putting them forward is to begin the debate about what form and shape these schemes ought to take. While perhaps no scheme will satisfactorily address all the modes of valuation applicable to human biological materials, I am confident that we can construct some method that would represent a significant improvement over property discourse. S. National Institutes of Health offer to replace corpses in medical schools with 'industry-standard digital cadavers'; when certain machines can appropriate the functions of human organs, while others are invested with intelligence; when the life of the body can be prolonged when the mind has ceased to function; when genetic change can be engineered and human beings cloned; when a foetus can be nurtured in an artificial womb, or jobbed-out to a surrogate mother; when we entrust automatons to land our jets or perform operations on our bodies; when the New York Times informs us that, contrary to what most of us had believed, there are three, four or possibly five genders; when we capriciously rebuild faces, breasts or thighs to conform to the moment's ideal of beauty; and when we dream of 'Robocops', 'Terminators' and 'Replicants', and long to live in a virtual realitythen concepts and definitions, values and beliefs, rights and laws, must be radically overhauled.

To the extent that things contribute to the good lifea life in which things are appropriately and authentically valuedthey are goods. A good differs from a bare thing in that a good must be valuable in accordance with some authentic mode of valuation, while a thing need not be valuable. Friendship, comfort, money, food, and luxuries are all goods, but so are, in the right circumstances, hate and greed. Murder and villainy are less likely candidates for goodness, but society has always found ways to value themsuch as killing an enemy or betraying thieves.

Second, in any sophisticated legal system, the quantity of information, thoughts, judgments, and rules contained in those sources far surpasses the ability of any one or group of individuals to fully comprehend. Judges, lawyers, and legislators, the legitimate explicators of the law, can realistically grasp only a small portion of these sources and their content and will only hold a general understanding of the remainder. Because lawyers within a particular field tend to do the same type of work, the areas in which they hold specialized and detailed knowledge of legal sources and the areas in respect of which they hold only a general knowledge of the law are relatively consistent from practitioner to practitioner.
